Purpose
This standard establishes minimum accessibility requirements for the procurement, licensing, renewal, or development of digital products and services.
It ensures alignment with:
- Title II of the Americans with Disabilities Act (ADA)
- Web Content Accessibility Guidelines (WCAG) 2.1 Level AA
- Section 508 of the Rehabilitation Act (where applicable)
- Texas Administrative Code 213 (if applicable)
Accessibility is a core requirement, not an optional feature, for digital tools used by students, employees, and the public.
Scope
These requirements apply to:
- Software (cloud-based or locally hosted)
- Learning management tools
- Student information systems
- Public-facing web applications
- Mobile applications
- Third-party integrations
- Digital courseware and publisher platforms
- Video platforms and media services
- Online forms and workflow systems
Accessibility Warranty Clause
Vendors are required to review the accessibility warranty found in Attachment Z. The standard language is below.
"To the extent applicable to Seller’s Services, Seller represents and warrants (the “EIR Accessibility Warranty”) that the electronic and information resources and all associated information, documentation, and support that it provides to University under the Agreement (collectively, the “EIRs”) comply with the applicable requirements set forth in 1 TAC Chapter 213 and 1 TAC Section 206.70 (as authorized by Subchapter M, Chapter 2054, Texas Government Code).
To the extent Seller becomes aware that the EIRs, or any portion thereof, do not comply with the EIR Accessibility Warranty, then Seller represents and warrants that it will, at no cost to University, either (1) perform all necessary remediation to make the EIRs satisfy the EIR Accessibility Warranty or (2) replace the EIRs with new EIRs that satisfy the EIR Accessibility Warranty. In the event that Seller fails or is unable to do so, then University may terminate the Agreement and Seller will refund to University all amounts University has paid under the Agreement within thirty (30) days after the termination date."
Vendor Changes to the Warranty
Vendors can propose their own warranty language as long as it substantially conforms to the warranty language shown in this section.
The institution may require temporary accommodations while remediation is underway.
Testing Rights
The institution reserves the right to:
- Conduct independent accessibility testing
- Request product demonstrations using assistive technologies
- Require access to test environments
